1. Agreement to Terms

These Terms & Conditions ("Terms") govern your access to and use of the TapCard platform, website, dashboard, APIs, and related services (collectively, the "Service") operated by TapCard ("TapCard", "we", "us", or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

TapCard provides digital loyalty card infrastructure for businesses, including issuance of passes compatible with Apple Wallet and Google Wallet, stamp / cashback / membership programs, push notifications, and analytics. The Service may evolve over time and we may add, modify, or remove features.

3. Eligibility & Accounts

  • You must be at least 18 years old and legally able to enter into a contract.
  • You are responsible for the accuracy of information you provide.
  • You are responsible for safeguarding your account credentials and for all activity under your account.
  • Notify us immediately at sudais.shafiq22@gmail.com if you suspect unauthorized use.

4. Subscriptions, Fees & Billing

Paid plans are billed in advance on a recurring basis (monthly or annually) at the rates published on tapcard.pk or as agreed in a separate order form. Fees are quoted in PKR unless otherwise stated and are exclusive of applicable taxes. Unless required by law, fees are non-refundable. You may cancel at any time; cancellation takes effect at the end of the current billing period.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful, fraudulent, or deceptive purpose.
  • Send spam, unsolicited marketing, or misleading push notifications.
  • Upload content that infringes intellectual property, is defamatory, obscene, or harmful.
  • Attempt to reverse engineer, probe, scan, or interfere with the Service.
  • Resell, sublicense, or expose the Service to third parties except as expressly permitted.

We may suspend or terminate accounts that violate these rules.

6. Customer Data

You retain all rights to data you or your customers submit to the Service ("Customer Data"). You grant TapCard a worldwide, non-exclusive license to host, process, transmit, and display Customer Data solely to provide and improve the Service. You are responsible for ensuring you have the necessary rights and consents to collect and process Customer Data, including under applicable privacy laws.

7. Third-Party Services

TapCard integrates with third-party services including Apple Wallet, Google Wallet, payment processors, and SMS / email providers. Your use of those services is governed by their own terms. We are not responsible for the availability or behavior of third-party services.

8. Intellectual Property

The Service, including all software, designs, logos, and content (excluding Customer Data), is the property of TapCard and its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, TapCard's aggregate liability for any claim arising out of or relating to the Service shall not exceed the fees paid by you to TapCard in the twelve (12) months preceding the claim. In no event shall TapCard be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data.

11. Indemnification

You agree to indemnify and hold harmless TapCard, its affiliates, and personnel from any claim or demand arising out of your use of the Service, your Customer Data, or your violation of these Terms or any law.

12. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your access immediately for material breach, non-payment, or to comply with law. Upon termination, your right to use the Service ends and we may delete Customer Data after a reasonable grace period.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute shall be subject to the exclusive jurisdiction of the courts of Lahore, Pakistan.
